information in this site came from my old website and robins home

beliefs are very strong on many issues and I believe we should be
exercising all our rights from harvesting our land to protecting it.

are of my Opinion in regards to the pays plat band.
it gives you most of my stand on band issues and gives you sometimes
ideas on how to deal with those issues.

I have been privy to much of the discussion that happened between
my uncle, Chief Gerald Bouchard and many of the principal men , of
the Pays Plat Band who were living there at the time when my Uncle
was Chief
Much of the discussion happens when they
have had a few drinks and then the emotions come out about the
real situation..
The history on this site is my recollection of events as told to
me by Gerald Bouchard, Mike Wanakamik, and others.

this is a short history of Pays
Plat from prior to becoming a reserve until now and an explanation of the
customary chief of pays plat.
there are some controversial issues that will be presented but it is what
was agreed to by the principal men involved with protecting the rights of
the Original Members who's ancestors used the traditional
territories since time immemorial.
We need to understand the importance of a custom or traditional chief
for the Pays Plat Band and why it needs to be restored to the original
members to pursue their rights and claims to their territories.
the integrity of their claims is
compromised by the recent influx of members who have no historical claim
to the lands and territories of the original band members of pays plat. Our Aboriginal Rights to hunt and
Utilize the Resources of our Traditional Territories must be Assured.

Important
Issue.
Because of the weak stance the Band has taken
on their land claims it is in a stagnant position,
We need to get it out of the lawyers hands and make it a little
political, the last band meeting he was saying the exact same thing they
said when my uncle Gerald was chief.
Im going to propose some things you should
consider and we need the chief and council to do it.

what claims the original members of the Pays Plat reservation have
against Canada, Ontario and or any corporations or individual
regarding their traditional territories including the reserve.

by Don Augers research is a land claim,
The Band must claim
management rights to a vast territory to assure that their treaty and
aboriginal right will be maintained and they will be able to assert their
treaty and aboriginal rights over those territories to feed their people
and to benefit off the natural resources.
The
band must claim title to their traditional territories and start using
them to benefit the members.
If we are waiting for the government to give us authority or permission
to use our lands , your great grandchildren will still be asking for
their rights.

The right of ways can be made to pay the Band what is owed just by
precedence,
the unique agreement with Ontario Hydro could make a
difference.

much of the history of the right of ways is known before they went through
But we
do know that liquor was involved and possibly money when Ontario hydro
right of way was confirmed, the Indian Agent was apparently not very
honest.

it by the
Canadian Pacific Railway. I am the

how many people know that the highway
went right across the graveyard of the ancestors of Pays Plat Band members
twice. Did you know that
the band has an agreement with
Ontario Hydro
and can be used for any grievances with the corporation and as a
precedence of dealing with the other right of ways. Highway and Railroad
who has a claim
against these right of way users

The only Agreement that has been made and is making revenue for the Band
was negotiated in 1991 no other progress has taken place since then
although there are two other users who go through the reserve,
those right of ways are a big part of pays plats future.

the band has an agreement with
Ontario Hydro
and they need to understand the importance of this
precedence.
payment of around 24
thousand per year since 1991 has paid an estimated
$500,000.00 in rental fees to the band
$500.000.00 damages
Hydro has also agreed that
DIAND is responsible for Payment of the Agreement from when the right of
way went through up until the agreement was signed with the Band and
Hydro. A retroactive payment is DIANDs responsibility.
We must go after the DIAND for
these damages and use the Ontario Hydro as a precedent on use of our
lands.
The Land and a Larger Land
Base
was suppose to address many issues it was high jacked by DIAND
and gives Ontario Hydro
a free pass across the pays plat reservation once again contrary to
our agreement.

There needs to be change to the band
membership code , more like get rid of it and make something simple
like ancestry
What should the policy be, why should we bring new members in when we
cant help the members now.
We should not allow members to be transferred in, we need to keep
our Bands integrity in regards to pays plat traditional territories.
Our membership should be based only on
historical and ancestral kinships and not for political purposes as
they have been

that need to be discussed
- Vaccines do they cause
disease
- Smart meters on houses
and the harm they do
healthy snacks, are they healthy or loaded with sugar, gmos and
chemicals
- Organic food vs.
conventional,
- does pesticides, herbicides and
artificial fertilizers harm your health and cause disease
- The importance of
vitamin D, C A B K and Anti Oxidants in our Foods.
- Are there natural and traditional Cures for
Cancer, Diabetes, heart disease and Asthma
- Why are we not teaching our children
how to prevent these diseases if we cant cure them.

has always problems with housing, we need to also provide the opportunity
for band members to buy land and build on it off.

the need for a Policy
that is directed by all band members
we are not so big that this cant be achieved economically
there is no action done for emergency housing, even when 3 or four
houses are empty of course that's for my request.
who is getting a house, who
has an application or what if any renovations are going to be made.
the quality of the construction
of the house, safety and lack of landscaping addressed.
The poor construction and
quality of certain unqualified non band member individuals being re
hired even after a costly major mistake or two

The Arena needs to be made functional, it is a
waste of 2 million Dollars.
We must vote
on whether there should be a forensic audit on our monies spent on this
project along with the wood lot.

the One million 300 thousand dollar over spending
on this building and what shape it is in, and being used
for storage of gasoline engines, its a shame what has taken place.

now that the arena has not been used, a totally useless building for
public purposes , a big 2 million dollar boat storage and archery
range

We need an estimate to see what it would take to make
the building useable. for any purpose other then rusting.

The business center has been abused for the last 25
years the restaurant was taken out to keep the competition away from
fertingigers store.
the gas
pumps are in terrible condition and the parking lot is pretty bad too ,
the bathrooms are starting to smell of septic tank gas..

the shape of the business center is terrible
the upkeep of the
business center is a major issue as it is the only building that is and
can generate income and provide work for the pays Plat Band members and its being allowed to rot
and deteriorate.
DEMAND AN
ACCOUNTING OF REVENUES OF THE CENTER
the terrible upkeep of the
building needs to be addressed and why is the restaurant not open or any
other business operating out of there. this building was constructed
to house many businesses and must be utilized to the fullest.
The band renovated the
restaurant right out of the picture, refused offers to rent the
restaurant and made sure there is no competition to fertingigers,
doing
good now because of the construction but with a restaurant it would have
done way better.

With the Ec Dev officer its hard to
say what is going on,
We need our Employees to account for
there
position and to report to the people what they are doing to create employment
on or off the reserve.
We need
a real economic plan
another
reason why an elders council is needed.

what is
happening in regards to economic development in pays plat and is
there any economic plans from the EDO
Is the EDO got any plans for the renting of space, or utilizing the
arena and business center for something that will generate revenue
for the band,
We need accountability from
this position as their is a growing population which are in need of jobs
and something to do.
A restaurant is feasible to operate
always was and always will be. it is a crucial service needed to provide
jobs for the youth and good food to the traveler, We must re install a
small restaurant in the business center.

The water in Pays Plat is very good to drink,
however protection of their water plant is warranted.

Is the
water plant safe in these days of terrorists
I do not see any fencing around the Bands water source
I do not see any security protecting your source of water from
contamination by accident or on purpose.
I believe that there should be monitoring the area 24 hours per day
and alarms if necessary as like towns protect their water.
A
gate should also be installed to stop traffick from access.
WE NEED TO PROTECT
OUR WATER SOURCE FROM ACCIDENTAL OR being PURPOSELY TAMPERED WITH.
The
water plant offers thanks to some members but their is no mention of
Gerald Bouchard who started the whole issue of bad water on the pays
plat reserve and who started the process to build the water plant.

We need to take our fair share of the resource,
its the Band Councils responsibility to enforce these rights.
who is responsible to assure that our rights are
protected and we are allowed to practice them.
We must
mandate the chief and council to take a more active role in the management
of our resources for our members.
If we dont
get control of the food resource on our traditional territory we will be
fighting the sports hunting even more for the same resources.

Our Treaty and or
Aboriginal Rights
Treaty Rights are obtained
from signing a treaty and as we know treaties or agreements seem to
be able to be broken by the Government or your added to one
under unilateral decision they have made.
Aboriginal Rights are
inherent rights, they are rights that you are born with and no
one can take them away from you, Our Aboriginal rights define our
culture which is one of hunting, fishing, trapping, foraging, and
gathering, we must be more protective of our territories.
Although we never cut the trees, plowed the land, dug up the earth,
it doesn't mean that we would not eventually do that,
The survival of our
culture depends on our ability to exercise our Aboriginal Rights
within our Traditional Territories.
We need to define what aboriginal rights are.
With our moose becoming more and
more scarce in the area it is necessary to have to travel sometimes
a hundred miles or more to find one. This situation makes it
impossible for many families to hunt their moose.
Our culture and traditions cannot be exercised because of the cost
of traveling to find the scarce resource, and competing against the
sports hunter.
We need to think about
using our traditional territories to feed our people their
traditional food and especially our elders, handi
capped, single mothers, non hunters, who can't hunt their own food.The
have a right the they can't use and its not fair.
it is our Right
How can we protect Our
Rights to hunt, fish, trap, forage and gather on our territories, We
need to use it to Feed our Families.
We need to manage our own resources it is
the only way that we will be able to insure our people that their
rights to hunt fish, gather and trap are maintained for our people.
this is
an issue that must be
addressed to resolve a mulitude of problems the band needs to
resolve..
